Good faith principle in the contractual legal relationship in Ecuador

The principle of good faith must be present in every legal relationship and is a rule of human behavior, acquiring special relevance in the contractual legal relationship. In the present study, through the analytical exegetical and legal theoretical methods, the treatment of good faith in contracts is analyzed from the doctrinal, normative, and jurisprudential point of view, and the reasons why the parties must act accordingly are shown. correct from before the signing of the contract until the stage after its execution. Even though Ecuadorian civil legislation does not expressly establish the validity of good faith in stages, both doctrine and jurisprudence have been broad in maintaining that the parties, when intervening in this type of legal relationship, must observe the rules of good faith, or otherwise they may lead to the legal and economic consequences that derive from it. Loyalty, probity and integrity constitute essential values that must govern the behavior of the parties in all contracts in Ecuador.
